The Disability Discrimination Act

The Disability Discrimination Act 1995 (DDA), which applies to virtually all organisations including small businesses with fewer than 15 employees, states that reasonable provision should be made to ensure that buildings are accessible and useable by all those who could be expected to use the building. DDA affects both the design of new buildings and existing buildings being used in the provision of goods, facilities and services. The act (which was merged and folded into the Equality Act 2010 in the UK) gives people with disabilities the following important rights so as not to be discriminated against:

  • In accessing every day goods and services e.g. local council services, healthcare services, banks, pubs, post offices, theatres, shops, cafes, places of worship, hairdressers etc.
  • In accessing certain private facilities.
  • In accessing important social goods and services e.g. healthcare, housing, education, and transport.

The Risks Of Non-Compliance

If an organisation does not address access issues in and around a building, the implications can be serious, ranging from heavy compensation claims to complete closure of business. Along with the possibility of having to defend a costly legal action, there is an opportunity risk. There are over 10 million people registered as disabled in the UK and over 11 million over the age of 65. It is estimated UK businesses could be losing as much as £50 billion a year from lost custom due to access issues.

Employers are required to make ‘reasonable adjustments’ to their premises for a particular applicant/employee including:

  • Building adjustments such as ramps, lifts, automatic doors etc.
  • Modified equipment, such as desks.
